ClearPath Terms of Service

ClearPath is a Cape Town navigation app built by Edward Leonard as a hobby/solo project. These terms govern your use of the ClearPath mobile app and the clearpath-cape-town-nav.lovable.app website (eventually moving to clearpathroutes.com). By installing or using ClearPath, you agree to them. If you don't, please uninstall.
TL;DR
- The app is provided as-is. No warranty. No promise of uptime.
- ClearPath shows you areas with elevated risk according to publicly available data. It is not a safety guarantee. Use your own judgment.
- ClearPath is not an emergency service. In an emergency, call 10111 (SAPS) or 112 (mobile emergency, all networks).
- The free tier is free. Premium features cost what the in-app price tag says.
- We can update or shut down the app at any time. We'll try to give notice.
What ClearPath does
ClearPath calculates driving routes through Cape Town that try to avoid areas flagged as higher-risk in publicly reported crime data (sourced from SAPS, supplemented by user reports). It also lets you:
- Save favourite places.
- Draw your own custom danger zones.
- Report incidents (potholes, hazards) for the benefit of other users.
- (Premium) Get alerts when you approach reported incidents within a 5 km radius.
- (Premium) Share your live location with someone you trust during a trip.
What ClearPath does NOT do
- ClearPath does not guarantee your safety. "Lower-risk" is not the same as "safe". Routes are calculated from historical and reported data — real-world conditions change minute to minute. Stay alert, lock your doors, and follow local safety advice regardless of what the app shows you.
- ClearPath is not an emergency service. If you are in immediate danger, contact emergency services directly: 10111 (SAPS), 112 (any mobile network), 107 (Cape Town municipal emergency).
- ClearPath does not replace your own judgment. If a route the app suggests looks wrong, don't take it. The app can be wrong.
- ClearPath does not work everywhere. It is built and validated for the Cape Town metro area. Outside that region, routes and risk data may be incomplete or absent.
Your responsibilities
You agree to:
- Use ClearPath only for lawful purposes.
- Not submit incident reports you know to be false.
- Not try to reverse-engineer, scrape, or abuse the service.
- Take responsibility for your own safety decisions. ClearPath is an assistive tool, not a chauffeur.
Account and data
ClearPath does not require an account, an email, or a phone number. Saved data (favourites, custom zones, reports) is tied to an anonymous device-install identifier. See the Privacy Policy for what we collect and what you can do about it.
Premium subscription (future)
When premium features become available:
- Pricing is shown in the app before you purchase.
- Payment is handled by Apple (App Store) or Google (Play Store) — we never see your card details.
- Refunds are handled by Apple/Google per their respective policies. We have no power to refund directly.
- Cancelling: do it in your App Store or Play Store subscription settings. The premium tier remains active until the end of the current billing period.
No warranty
ClearPath is provided "AS IS" and "AS AVAILABLE", without warranty of any kind, express or implied, including but not limited to fitness for a particular purpose, accuracy of routing, accuracy of risk data, or non-infringement.
Limitation of liability
To the maximum extent permitted by applicable law, the developer (Edward Leonard) will not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of property, income, data, or use — arising from your use of, or inability to use, ClearPath. This includes any damages arising from following or not following a route the app suggested.
Some jurisdictions don't allow these limitations; in those, our liability is limited to the maximum extent permitted by law.
Termination
We may suspend or terminate access to the service (in whole or in part) at any time, for any reason, including if you violate these terms. You may stop using ClearPath at any time by uninstalling the app.
Changes to these terms
We may update these terms when materially relevant. The "Last updated" date above will change. Continued use after a change means you accept the new terms.

Governing law
These terms are governed by the laws of the Netherlands (where the developer is resident). Any dispute will be resolved in the courts of the Netherlands, except where local consumer protection law gives you the right to bring claims in your own country.
